Health Care Reform: Why It's Safe From The Supreme Court


I saw a discussion between Ali Velshi and Fareed Zakaria on "Your Money" in which Velshi floated a false equivalency relating to the mandate in question. The argument Velshi seemed to be making is that Mandate issue would apply to both a Single Payer plan and the Insurance Mandate that is being discussed now. At issue is whether or not the State can force the American People to buy a product from a Private Sector Company ... in this case Health Care. If we are talking a Comprehensive Universal Single Payer Health Care System supported by taxation that isn't an issue. Americans pay taxes that support infrastructure, education the military, etc. There is no issue with taxes being levied to support services that promote the common good. The Post Office, hard coded into the US Constitution, is an example of that, and was a message from the Founding Fathers as to what they viewed as an acceptable use of taxes for public services. Anyone using the US Constitution as their argument as to why Medicare, and Social Security, or a Comprehensive Universal Single Payer Health Care System is unconstitutional has to explain why the Founding Fathers included an exact example of a service in support of the General Welfare, the Post Office, in the US Constitution itself. Don't throw the 10th Amendment into our faces, it isn't germane.
