Health Care Law: All Hail The Failure Of Conventional Wisdom


What I came away with is that a Coup occurred in the Conservative Wing of the Supreme Court. We know in name this has been "The Roberts Court", but most would contend via tenure that Scalia was the Alpha Male on the Conservative side of the Court. Another article on this site noted that Scalia's dissent read more like a Majority Opinion ... perhaps it was Scalia's understanding that ACA was going to be struck down, but something evidently changed.



Additionally, another example of Conventional Wisdom fell today, that Anthony Kennedy was the swing vote in a galvanized court. For now, at least, that is no longer true.



In one fell swoop, Roberts upheld the ACA when he could have killed it. He also established himself as less than rigid as advertised.



Chief Justice Roberts definitely took the reins of his court.
