I think what Fleischer in-artfully was trying to say is that the Germans (Nazis) of WWII wore uniforms, so there was some sort of compliance with the established framework of war. However, partisans, and guerrillas during WWII were soldiers as well and didn't wear uniforms, though they were legitimate combatants in the conflict, and the Allies had no problem deploying them. As such, partisans and guerrillas ... within the framework of traditional war ... were terrorists.
The main problem with GITMO is that it is a repeat of the failed Operation Phoenix of the Vietnam War, and as such the majority of detainees at GITMO are likely innocent of any terrorist activity ... which explains why so many of them haven't even been charged with a crime.
